Terms of service
Effective 28 September 2026. Orders placed before this date are governed by the terms in force when they were placed.
Please read section 12 carefully. It requires most disputes to be resolved by binding individual arbitration instead of in court, and it waives class actions and jury trials. You can opt out of arbitration within 30 days of your first order (section 12.9). Small claims court is always available.
1. Who we are and what this covers
jivansage.com and JivanSage products are operated and sold by Aternom Inc, a California corporation ("JivanSage", "we", "us"). Contact: hello@jivansage.com · PO Box 867, Carmichael, CA 95609, United States.
These terms, together with our shipping, returns and privacy policies (which form part of them), are the agreement between you and us for using this site and buying from us. You accept them when you place an order or check the terms box at checkout. If you do not agree, please do not order.
You must be at least 18, or the age of majority where you live, and ordering for personal use. We ship to US addresses only.
2. The product and how to use it safely
Our bars are cosmetic cleansing products. They are not drugs, are not medicated, and are not intended to diagnose, treat, cure, mitigate or prevent any disease or condition. We make no claim that they will lighten, even out, clear or otherwise change your skin, and nothing on this site, on our label or in any message from us is medical advice.
Before using the bar you agree to:
- Read the full ingredient list on the product page and the label, and not use the bar if you know or suspect you are sensitive to any ingredient.
- Patch test on a small area and wait 24 hours before first full use, and stop immediately if you see redness, burning, stinging, swelling, itching or other irritation.
- Use it externally only, keep it away from your eyes, and keep it out of reach of children.
- Use sunscreen during the day, because the bar contains retinol, which can increase sensitivity to sunlight.
- Speak to a doctor before use if you are pregnant or breastfeeding, have a skin condition, broken or sunburned skin, or are using prescription skin treatments.
Kojic acid, retinol, vitamin C and fragrance-bearing oils can cause irritation, dryness, contact dermatitis or allergic reaction in some people even when used as directed. We tell you this so you can decide whether the product is right for you. If you react, stop using it and email us: we refund reactions whether or not the bar is opened (see returns).
To report a serious reaction, email hello@jivansage.com or write to the address above. We record every report we receive.
3. Orders and acceptance
Your order is an offer to buy. We accept it when we ship it; the Stripe confirmation email is a receipt, not acceptance. We may decline or cancel any order, including orders that appear fraudulent, exceed reasonable personal quantities, are placed for resale without our written agreement, or were placed at a price shown in error. If we cancel after you have paid, we refund you in full.
4. Prices and payment
Prices are in US dollars. Shipping and any sales tax are shown at checkout before you pay. Prices may change, but never on an order we have accepted. If a product is listed at an obviously wrong price because of a typographical or technical error, we will tell you and let you choose to pay the correct price or cancel with a full refund.
Payment is processed by Stripe under Stripe's terms. We never receive or store your full card number.
5. Shipping, title and risk
Delivery estimates are estimates, not guarantees. Title to the goods passes to you when we hand them to the carrier. Risk of loss stays with us until delivery, so if the carrier loses or damages your parcel we replace or refund it as set out in our shipping policy.
6. Returns and refunds
Our returns policy sets out your return and refund rights, and it is our only guarantee. It is a satisfaction policy, not a written warranty.
7. Product description
We describe and photograph our products as accurately as we can. Because turmeric and other plant-derived ingredients vary between batches, colour, speckling, scent and size differ slightly from bar to bar and from the photos. These variations are not defects.
8. Disclaimer of warranties
Except as stated in our returns policy and to the fullest extent permitted by law, the products and this site are provided "as is" and "as available", and we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant any particular result from using the product, that it will suit your skin, or that the site will be uninterrupted or error-free.
Some states do not allow the exclusion of implied warranties, so some of this may not apply to you. Where an implied warranty cannot be excluded, it is limited to 30 days from delivery, to the extent the law allows.
9. Limitation of liability
To the fullest extent permitted by law, neither we nor our officers, directors, employees or agents will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, arising out of or relating to these terms, the site or any product, however caused and even if we were told they were possible. Our total liability for all claims relating to an order will not exceed the greater of the amount you paid for that order or US$100.
These limits do not apply where the law does not allow them, including liability for fraud, for wilful or grossly negligent misconduct, or for violations of law that cannot be limited by contract, and they do not limit any right you have under applicable consumer protection law that cannot be waived.
10. Your responsibilities
You agree to give accurate order and shipping information, to use the product only as directed, and not to resell our products as new or repackage, relabel or alter them. You are responsible for any use of the product contrary to its label or these terms.
11. The site and our content
JIVANSAGE™, the JivanSage name, mark and label, our product photography and all text and design on this site belong to Aternom Inc. You may view and share pages for personal, non-commercial purposes; any other use needs our written permission. You may not use the site to break the law, interfere with its operation, probe or attack its security, or harvest data from it by automated means.
You are free to review, discuss and criticise our products anywhere. If you send us ideas or suggestions, we may use them without obligation to you.
Links to other sites, including Stripe and carriers, are for convenience; we are not responsible for their content or practices.
12. Resolving disputes: informal process first, then individual arbitration
12.1 Talk to us first. Most problems are fixed by an email. Before starting any formal proceeding, you and we each agree to send the other a written notice describing the claim, the relief sought and, for you, your name, email and order number. Send yours to hello@jivansage.com and the mailing address above. We will send ours to the email you ordered with. Neither side may start arbitration or a lawsuit until 45 days after the notice is received, and during that time we will each try in good faith to resolve it, including, if either side asks, by a phone or video call you take part in personally. Limitation periods are paused while this process runs.
12.2 Agreement to arbitrate. If we cannot resolve it, you and we agree that any dispute, claim or controversy arising out of or relating to these terms, the site, any product or any order (a "claim") will be resolved by binding individual arbitration, not in court, except as set out in 12.3. This includes claims that arose before you accepted these terms and questions about whether a claim must be arbitrated, except that a court decides questions about the validity or enforceability of 12.5 (class and representative waiver) and 12.7 (mass filings). The Federal Arbitration Act governs this section.
12.3 Exceptions. Either of us may bring an individual claim in small claims court if it qualifies and stays there. Either of us may seek relief in court to stop infringement or misuse of intellectual property. Nothing here stops you from bringing an issue to the attention of a government agency.
12.4 How arbitration works. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, available at adr.org, and decided by a single arbitrator. It will take place by video or phone, on written submissions, or in person in the county where you live, as you choose. Fees are paid as the AAA rules provide; if your share of the filing fee is more than the fee to file a lawsuit in your local court, we will pay the difference. The arbitrator may award the same individual relief a court could, applies these terms and the governing law, and issues a written decision. Judgment on the award may be entered in any court with jurisdiction.
12.5 No class actions and no jury. You and we may each bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and the arbitrator may not consolidate claims of more than one person or award relief to anyone other than the individual party. You and we each waive the right to a jury trial for any claim covered by this section. If a court finds this paragraph unenforceable for a particular claim or type of relief, that claim or relief (and only that) will be decided in court under section 13, after all individual claims have been arbitrated, and will not proceed in arbitration.
12.6 Public injunctive relief. If you seek public injunctive relief that applicable law does not allow to be waived, that request will be decided by a court under section 13 after the individual arbitration is finished, and the court proceeding will be stayed until then.
12.7 Mass filings. If 25 or more similar claims are brought against us by the same or coordinated counsel or organisations, they will be administered in batches of up to 50 claims each, one batch at a time, with the AAA's rules for multiple case filings applying where relevant. Fees for each batch are payable only when that batch is filed, and limitation periods are paused for claims waiting in later batches. Both sides agree to cooperate in good faith so these claims are resolved efficiently.
12.8 Future changes. If we change this section after you accept it, the change will not apply to a claim you notified us of before the change took effect.
12.9 Your right to opt out. You can opt out of this arbitration agreement by emailing hello@jivansage.com within 30 days of your first order accepted under these terms, with the subject line "Arbitration opt-out" and your name, order email and a clear statement that you opt out. Opting out does not affect any other part of these terms.
12.10 Severability of this section. Except as stated in 12.5 and 12.6, if any part of this section is found unenforceable, the rest remains in effect.
13. Governing law and courts
These terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs section 12. Any claim not subject to arbitration will be brought only in the state or federal courts located in Sacramento County, California, and you and we consent to their jurisdiction, unless the law where you live gives you the right to sue in your home courts.
14. General
Changes. We may update these terms by posting a new version with a new effective date. The version in force when you place an order applies to that order, subject to 12.8.
Events beyond our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as carrier disruption, natural disasters, supplier failure or outages. Your right to a refund for anything we cannot deliver is unaffected.
Everything else. These terms are the entire agreement between us about their subject. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not transfer these terms; we may transfer them to a successor to our business. Headings are for convenience only. Nothing in these terms limits any right you have under law that cannot be excluded by contract.
